The working draft of the House version of the Food Safety Legislation has been relaeased. The primary authors of the bill are Chairman Emeterius John D. Dingell, Chairs Henry A. Waxman, Frank Pallone, and Bart Stupak, and Reps. Diana DeGette and Betty Sutton.

So the hot ingredient for 2009 is stevia. Or is it Reb A? Or is it Reb A 98%? Or is it Rebiana? And for just which of the stevia-based sweeteners has FDA determined that it has no objections to on the basis of a dossier that it has reviewed? It's all so confusing.

FDA recently send a number of warning letters to websites offering products purporting to be dietary supplements that can cure or prevent the H1N1 virus (swine flu). The way those letters were addressed makes me wonder if the Agency really cares if they get there.

The old pronouncement that the Dietary Supplement Industry is “unregulated” used to be the mantra of newspapers. No one cared particularly as long as the money was still flowing. One cynical comment overheard was: “No one reads newspapers anyway.” Well how about Sports Illustrated? An article in the latest edition of SI poses the same statement in a new and detailed way and – well – lots of folks read this magazine. What to do?

The FDA has clearly stated, and restated, the requirements for an antioxidant claim. This opinion is contrary to popular momentum in the industry. It seems that every day new products appear with claims based solely on ORAC or some other non-specific testing method clearly not allowed by the Antioxidant Final Rule.

There is a natural reaction that forces a business person to consume a piece of news with a filter evaluating the significance of the information relative to the opportunity it provides your business. Unfortunately for our industry, many organizations that can be associated with this sector do not have a moral counter-check that stops them from doing public harm and from violating regulations as they take advantage of these stories and another common human failing – gullibility.
